Update on Proposed Development St. Paul’s Playing Fields in St Anne’s

12 Mar 2021

As you will be aware Clonres CLG – the company behind Clontarf Residents’ Association – was granted leave to take a Judicial Review (JR) of An Bord Pleanála’s decision to grant permission for a large-scale development on the St Paul’s playing fields.

The case is being heard by Mr Justice Humphreys.  The first stage of the JR has been heard this week and covered the domestic law issues.  Judgement has been reserved.

The other action to protect these lands is the call to have the lands designated as a Special Protection Area (SPA).  As you will be aware the Minister had opposed our application to have the lands designated.

She had claimed it should have been made when the original Bull Island SPA designation was made, or in 2018 when Marlet/Crekav’s environmental survey established that the lands were the primary ex-situ feeding site for the protected Brent geese.

The Court had found in favour of the State and we appealed that decision.  That case was heard in the Court of Appeal on March 2nd and judgement has been reserved in that case also.
