Statement from Clontarf Residents' Association

CRA would like to remind you that the final date for submissions on the proposed changes to the Housing and Planning Development Bill 2019 is this Monday, 27th January 2020.

“This consultation is an important opportunity for everyone with an interest in environmental democracy and access to justice to have their say on these alarming proposals.”

The changes proposed in this Bill will severely restrict the rights of groups to take a Judicial Review. Some of the proposed changes include:

-a requirement for a group to have been in existence for 3 years and to have over 100 members;
-a change to the existing cost rules which would mean that local communities would have to raise considerable funds in order to take a case;
-a change to the standing requirement for applicants from “sufficient” interest to “substantial” interest; and,
-a requirement that applicants must be “directly affected by a proposed development” and “in a way which is peculiar or personal”.
